SCS WEBSITE AND SYSTEMS TERMS OF USE

PLEASE READ THIS AGREEMENT AND PRIVACY POLICY CAREFULLY BEFORE USING THE SCS WEBSITE AND SYSTEMS.

  1. General

Georgetown University School of Continuing Studies and its third-party business Affiliates or Partners (“SCS,” “we,” or “us”) provides access to the SCS website and related systems, including the SCS website properties at scs.georgetown.edu, scsonline.georgetown.edu, the prospective student customer relationship management (CRM) database and our application system (together, the SCS Website and Systems), subject to your agreement to and compliance with the terms and conditions set forth in this terms of use agreement, including the attached privacy policy (together, the “Agreement”). This Agreement governs the relationship between SCS and you, the visitor/user of the SCS Website and Systems (in each case, “you”) with respect to your use of the SCS Website and Systems. It is important that you read carefully and make sure that you understand and agree to the terms and conditions set forth in this Agreement before using the SCS Website and Systems. By using the SCS Website and Systems, you agree to be bound by this Agreement. If you do not agree to these terms and conditions, please do not use the SCS Website and Systems.

We may at any time, at our sole discretion, revise or otherwise update this Agreement by posting an amended Agreement on the SCS Website and Systems. Any changes that we make to this Agreement will be effective immediately upon posting. Your use of the SCS Website and Systems following the posting of an updated Agreement constitutes acceptance of the updated Agreement.

SCS reserves the right, at any time and for any reason, to modify or discontinue, temporarily or permanently, the SCS Website and Systems (or any part thereof) without notice. You agree that SCS shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the SCS Website and Systems, or of any Materials (as defined below).

  1. Nature of the Service

SCS is committed to respecting your privacy. The terms of use and privacy policy discloses the information gathering and dissemination practices for the SCS Website and Systems. By using the SCS Website and Systems, you are consenting to our collection and use of your information in accordance with this privacy policy. The SCS Website and Systems are provided as an information service only and does not constitute legal, accounting, educational, career or professional advice on any subject matter. While Georgetown University will seek continuously to update the SCS Website and Systems, the information therein may not be entirely up-to-date or complete.

  1. Copyright and Proprietary Information

The information, content, images and other materials contained on or otherwise made available to you through the SCS Website and Systems (the “Materials”) are intended to educate and inform you about SCS and the services and resources it provides. You acknowledge and agree that the Materials are and shall remain the property of SCS and/or its licensors, and are protected by copyright, trademark, and/or other proprietary rights and laws. Except as expressly authorized in advance by SCS, you agree not to copy, distribute, transmit, display, perform or create derivative works of the SCS Website and Systems or any of the Materials, subject to the application of the limited license described in paragraph 4. The database structure, coding, and SCS Website and Systems content are the sole property of SCS.

  1. Limited Use License

You are hereby granted a limited, personal, revocable, non-transferable and non-sublicensable license (a) to access the SCS Website and Systems via the Internet solely for purposes of viewing such Materials for your personal, non-commercial use and (b) to print out pages of this SCS Website and Systems for your personal, non-commercial use. The trademarks, logos, and service marks displayed on the SCS Website and Systems (collectively the “Trademarks”) are the registered and unregistered trademarks of SCS and other third parties, and may not be used by you in any manner except as permitted in this Paragraph 4. Nothing contained on the SCS Website and Systems should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Trademark without the express written permission of SCS or the third party owner of the Trademark. You may not alter or remove any copyright symbol or other identification concerning authorship of any of the Materials. Commercial redistribution or commercial publication of any Material is strictly prohibited. Sub-licensing, reselling, republication or other commercial forms of redistribution of any of the data or software used in the SCS Website and Systems, including Internet posting, electronic mailing, faxing, archiving in a public database, redistributing via a computer network or in printed form, to any third party, are strictly prohibited.

  1. No Implied Endorsement

The Materials, ideas, and issues discussed and/or presented on the SCS Website and Systems do not imply the expression of any opinion on the part of Georgetown University or SCS concerning any idea or issue discussed on the SCS Website and Systems. The Materials or information in the SCS Website and Systems does not necessarily represent the official views or position of Georgetown University or SCS.

  1. Limitation of Liability

IN NO EVENT SHALL SCS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OF BUSINESS OR PROFITS, OR FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY USE OF, OR INABILITY TO USE, THE SCS WEBSITE AND SYSTEMS, EVEN IF SCS IS PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY OTHER CLAIM BY YOU OR ANY OTHER PERSON.

  1. Disclaimer of Warranty

NEITHER SCS NOR ITS EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS WARRANTS THAT ACCESS TO AND USE OF THE SCS WEBSITE AND SYSTEMS WILL BE FREE FROM INTERRUPTIONS OR FREE FROM ERRORS, OR THAT ANY MATERIAL OR OTHER INFORMATION ACCESSIBLE FROM OR RELATED TO THE SCS WEBSITE AND SYSTEMS IS FREE OF VIRUSES, WORMS, OR OTHER HARMFUL COMPONENTS. THE SCS WEBSITE AND SYSTEMS IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NO WARRANTY IS MADE AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SCS WEBSITE AND SYSTEMS, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY MATERIAL, INFORMATION, OR SERVICE PROVIDED. You expressly acknowledge and agree that information, text, graphics, and hyperlinks provided to you through the SCS Website and Systems and located throughout the combined global electronic networks known as the Internet and the World-Wide Web are provided solely as a resource and a convenience to you. SCS makes no warranty, either express or implied, as to the accuracy, reliability, or content of such information, text, graphics, and hyperlinks. Unless otherwise explicitly stated, SCS is not responsible for the content of other websites and systems, any updates or changes to such websites and systems, or the privacy or other practices of such websites and systems. Accordingly, we strongly encourage you to become familiar with the terms of use and practices of any websites or systems that are linked to the SCS Website and Systems.

  1. Indemnification

You agree to defend, indemnify and hold harmless SCS, its employees, agents, third-party content providers and licensors, and each of their respective partners, employees, representatives and agents, from and against all claims, losses, costs, damages, liabilities, and expenses (including but not limited to attorneys fees) arising out of: (a) your activities in connection with the SCS Website and Systems; (b) any violation of this Agreement by you; (c) any improper or unauthorized use of the Materials by you; or (d) any allegation that anything you transmit through or in connection with the SCS Website and Systems infringes or otherwise violates the copyright, trademark, trade secret, privacy, or other rights of any third party.

  1. Privacy Policy

Your use of the SCS Website and Systems is governed by our Privacy Policy (the “Privacy Policy”). Please read carefully our Privacy Policy, which can be found below, before using this SCS Website and Systems.

  1. Arbitration and Governing Law

Any claims against SCS or its employees, agents, third-party content providers or licensors that arise from or relate to use of the SCS Website and Systems shall be governed by the laws of the District of Columbia. Any controversy or claim arising out of or relating to this Agreement, or any breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association in Washington, DC, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

  1. Special Provisions Applicable to Users Outside the United States

By using the SCS Website and Systems, you consent to having your personal data transferred to and processed in the United States.

  1. Termination and Survival

SCS may terminate this Agreement and delete your account in its sole discretion at any time and with or without notice to you. You may terminate this Agreement and request that we delete your account at any time by contacting us.

  1. Miscellaneous

This Agreement, together with any of our policies referred to herein, is the entire Agreement between you and us relating to your use of the SCS Website and Systems, and supersedes any and all prior or contemporaneous written or oral agreements between you and us regarding the same subject matter. The provisions of this Agreement shall inure to the benefit of Georgetown University and its employees, agents, third-party content providers and licensors. If any provision of this Agreement is found for any reason to be unlawful, void, or unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provision. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. This Agreement is not assignable, transferable or sublicensable by you to any third party.

 

PRIVACY POLICY

This Privacy Policy describes the personally identifiable information that Georgetown University School of Continuing Studies (“SCS,” “we,” “us”) collects in the United States through our Website and Systems accessed through scs.georgetown.edu (all other systems see paragraph 1) and how we use that information. Please note that this Privacy Policy applies solely to our online information-gathering and dissemination practices in connection with the SCS Website and Systems, and does not apply to any of our practices conducted offline or outside of the U.S.

The Information We Collect and How We Use It

SCS collects two types of information about users of the SCS Website and Systems:

(1) Personally identifiable information: Certain services, such as the Request Information Form, to which you may gain access through the SCS Website and Systems, may require you to provide personally identifiable information. We use such personally identifiable information to respond to your inquiries and to send you information about our courses and programs. If you decide at any time that you no longer wish to receive emails from us, please refer to the paragraph below headed “Changing or Deleting Personal Information.”

If you contact us by email through the SCS Website and Systems or submit any information, such as a phone number, through the SCS Website and Systems, we will collect any personally identifiable information that you transmit to us and we may keep a record of your contact information and correspondence, and we reserve the right to use your email address and phone number, and any information that you provide to us in your message, to communicate with you. In addition, we may send by email important administrative information regarding the SCS Website and Systems or services to users who have provided us with their email addresses. Such information may be important to your use of the SCS Website and Systems and is regarding our ongoing relationship with you.

(2) Non-personally identifiable information: We use this information to conduct typical marketing activities, including behavioral and personalized retargeting. We retarget visitors to our website with additional advertising after they visit our site or if they use search engines to look up terms related to our programs. We may use cookies to collect non-personally identifiable information in connection with the SCS Website and Systems. Our web pages may incorporate “pixel tags,” “web beacons,” or similar tracking technologies (collectively, “pixel tags”) that allow us or our agents to track the actions of users of our SCS Website and Systems. We may also aggregate your information with similar data collected from other users to help us improve our SCS Website and Systems, and the services that we provide through our SCS Website and Systems.

We may use the information collected for the following purposes, in addition to those described above:

  • Tailoring the SCS Website and Systems to user needs and improving our service;
  • Generating data and reports about usage of the SCS Website and Systems and its content;
  • Supporting the functioning and security of the SCS website and our network systems; protecting our rights, property, or safety or those of others; and research; and
  • Providing customer service and application assistance to prospective students.

How We Disclose the Information We Gather

We reserve the right to provide the information we collect to our employees, contractors, agents, and designees to the extent necessary to enable them to perform certain services (e.g., web hosting and maintenance services, improving the SCS Website and Systems and its features, or customer service) on our behalf. We also reserve the right to disclose such information to any third party if we believe that we are required to do so for any or all of the following reasons: (i) by law; (ii) to comply with legal processes or governmental requests; (iii) to prevent, investigate, detect, or prosecute criminal offenses or attacks on the technical integrity of the SCS Website and Systems or our network; and/or (iv) to protect the rights, property, or safety of SCS and its affiliates, its and their partners and employees, the users of the SCS Website and Systems, and the public.

We may share the information we gather with third parties, including our Affiliates or Partners, to perform functions and provide services to us including, without limitation, outreach and assistance to you with regard to selecting a program of interest, completing an application, and other related activities. We may provide collected information, including personally identifiable information, to those third-party Affiliates and Partners for those purposes. In addition, we may share with third parties information about the use of the SCS Website and Systems and its content that is aggregated or anonymized so that it does not identify any individual user.

Changing or Deleting Personal Information

If you would like to change your personal information or if you no longer wish to receive materials from us or want your personal information removed from the SCS Website and Systems, please contact us at scsmarketing@georgetown.edu. Alternatively, when you receive materials from us by email or other communications you can make use of the “opt out” provision in such communications so that we know that you no longer wish to receive such materials from us.

Security

SCS will use reasonable security measures to assist in protecting against the loss, misuse, and alteration of personally identifiable information which is under our control. Unfortunately, no security system, or system of transmitting data over the Internet, can be guaranteed to be 100% secure. As a result, while we undertake commercially reasonable efforts to protect your personally identifiable information, we cannot guarantee the security of our servers, the means by which information is transmitted between your computer and SCS’s servers, or any information provided to us or to any third party through or in connection with the SCS Website and Systems. You provide all such information entirely at your own risk.

Revisions to Privacy Policy

SCS reserves the right to update and revise this Privacy Policy at any time. You can determine if this Privacy Policy has been revised since your last visit by referring to the “Date this Privacy Policy was Last Updated” date at the top of this page. Your use of our SCS Website and Systems constitutes your acceptance of the terms of the Privacy Policy as amended or revised by us, and you should therefore review this Privacy Policy regularly to ensure that you are aware of its terms. Your continued use of this SCS Website and Systems and/or continued provision of personally identifiable information to us will be subject to the terms of the then-current Privacy Policy.
